Despite a “NO” vote by Beavercreek City Council, in April 2024, the RaceTrac Truck Stop STILL HAS A STRONG POSSIBILITY OF BEING BUILT.
RaceTrac is standing by, waiting to see whether Beavercreek voters in Precinct 34 gather enough signatures to place several “Dry Petition” issues on the November 2024 ballot, banning sales of carry-out beer, wine, and spirits within the Precinct.
This ban deters RaceTrac using this location due to significantly decreasing their profits.
IF the 34th Precinct Voters don’t gather sufficient signatures on the Dry Petitions to get the issues on the ballot (plus we must also vote to prohibit carry-out beer, wine, and liquor sales on the November ballot), the following course of action could take place:
1. RaceTrac may sue the City of Beavercreek to override the City’s refusal to approve their gas station / truck stop. RaceTrac has the finances to win the lawsuit.
2. Beavercreek residents would foot the bill for defending RaceTrac’s lawsuit out of taxpayer dollars.
3. Either the court will side with RaceTrac or Beavercreek City would be forced to concede given the costs associated. RaceTrac would then prevail in their effort to build a Truck Stop right next to our homes.
4. ALL Beavercreek residents would permanently lose US Rt 35 / Factory Rd. and Orchard Lane overpass considerations (the best and safest solution for Beavercreek residents) by the state government since the intersection will have the RaceTrac truck stop within the zone of future overpass land required.

RaceTrac proposes to build a 24/7 “Extended Diesel Offering” truck stop / gas station / convenience store / general retail /restaurants / Vehicle Service Station on this parcel. RaceTrac included “site-plan” type diagrams with their application.
This proposed development is right in the face of nearby residential neighborhoods and includes:
*multiple entrances and exits on Factory and Shakertown Roads at an already convoluted, treacherous “Super Streets” intersection;
*24/7 light, noise, water & air pollution;
*noisy, polluting 18 wheeler truck parking with trucks running their engines all day and night for heating and cooling;
*likelihood of increased crime, drug use/sales, and human trafficking along Rt 35;
*increased traffic congestion & accidents for neighboring homes & families accessing Factory Rd and Rt 35 to get to school, work, soccer games, grocery shopping, errands, etc.
In addition to these problematic issues, an overwhelming list of environmental concerns regarding this parcel is presented below.
Truck Stop Timeline:
On October, 31, 2023, an application was filed on behalf of RaceTrac, a Georgia-based truck stop developer wanting to expand into Ohio. The initial application requested rezoning of the parcel at the southwest corner of the US Rt 35 / Factory Rd. intersection in Beavercreek from B3 & B-PUD (business zoning) to C-PUD (Commercial Planned Unit Development).
In early 2024, various concerned Beavercreek individuals opposing the RaceTrac Truck Stop joined forces and began gathering information, coordinating environmental experts, posting anti-truck-stop petitions, arranging TV & newspaper coverage, and blasting out information on social media to educate Beavercreek residents and bring attention to the proposed truck stop. This group became: “Beavercreek Citizens for Responsible Development.”
At the March 6, 2024 public hearing, despite an overflowing meeting room and a huge public outcry, the Beavercreek Planning Commission (appointed advisory body) unanimously voted to recommend approval (with conditions) of a RaceTrac GAS STATION. One of their approval recommendation “conditions” was that no TRUCK STOP component could be built.
On April 22, 2024, the Beavercreek City Council (elected voting body) faced another public hearing room packed with outraged citizens and environmental experts. After painstaking deliberation, Beavercreek City Council did NOT approve RaceTrac’s rezoning application for either a Gas Station or a Truck Stop. THANK YOU FOR LISTENING TO YOUR CITIZENS, BEAVERCREEK CITY COUNCIL!!
However… we are not yet done with RaceTrac. RaceTrac’s attorneys have indicated that they will sue the City of Beavercreek for not approving their full truck stop plan. The ONLY thing stopping RaceTrac from moving forward with, and ultimately prevailing in, their lawsuit against Beavercreek City is the citizen-driven Dry Petitions in the 34th Precinct. Registered voters in the 34th Precinct are ALL THAT STANDS BETWEEN AN EXPENSIVE RACETRAC LAWSUIT AND A TERRIBLE TRUCK STOP in Beavercreek at the corner of US Rt 35 and Factory Rd.
PLEASE – Stand up for your families, environment, and community. Stop by our petition-signing events, get the Dry Petition Issues on November’s Ballot, and vote to NOT APPROVE the sale of carry-out beer, wine, and liquor in the 34th Precinct. We are BEAVERCREEK STRONG and we stand up for what is best for us, not for out-of-state corporations only interested in exploiting & polluting our beautiful city for profit, regardless of the impact on our families & community!
There are a huge number of environmental concerns with this problematic parcel.
1. The truck stop / gas station parcel is 100% located in a FEMA flood plain.
2. The truck stop / gas station project requires bringing in SEVEN FEET of fill (per the planning staff report) to raise the level of the entire convenience store / restaurant / retail building two feet above base flood elevation. In addition to all the other problems this development would create, the truck stop building would sit on top of its own private hill, to be even more in the face of surrounding homes and a much more prominent visual blight on the landscape.
3. The 24/7 truck stop fill, noise, and activity will disrupt wildlife habitats and wetlands.
4. The Beaver Creek, Little Beaver Creek, and the Little Miami River are located directly across Factory Rd. Surface run-off contaminated with gas/other toxic products that are routinely spilled on gas station paved surfaces will drain into our rivers, regardless of containment measures.
***THE LITTLE MIAMI RIVER RUNS RIGHT ALONG OUR SOCCER FIELDS AND COULD TRANSPORT HAZARDOUS WASTE FROM THE GAS STATION TO THAT AREA!
5. At least a portion of the bigger parcel within which RaceTrac’s proposed development is a known hazardous waste site. There is a “hazardous waste material” easement on the RaceTrac parcel. Digging or disrupting the contaminated soil / water could release new contamination.
6. The underground gas tanks have to be specially anchored so they don’t rise up and float away in heavy rains. Gas tank leaks can pollute our soil and rivers before anyone even realizes they happened. With the soccer fields nearby, that could be tragic to our families as well as wildlife.
7. A wastewater treatment plant is located across Factory Rd from the proposed truck stop. Soil and water containing hazardous waste had to be removed or contained when county sewer lines were being run along Factory Rd towards the treatment plant.
8. There is a 10” diameter, high pressure, high volume, intrastate, underground, natural gas pipeline on this parcel. Although there is an “easement” that prohibits RaceTrac from building near / above the high-pressure gas pipeline, the developer’s diagrams indicate that vehicles can drive over the pipeline / pipeline easement in one area. Unstable floodplain soil combined with a massive, high-pressure / high volume gas pipeline? Sounds like a disaster in the making.
9. This area of Factory Rd has consistently flooded for many years. RaceTrac proposes to build on or pave a substantial amount of land with a large building, gas pumps, parking spaces and three “driveway” entrances and exits, including a very long driveway that empties out onto Shakertown Rd. This huge increase in impervious surface (buildings and asphalt prohibit natural drainage and cause run-off into the surrounding slow-draining wetlands) will only increase the potential for flooding problems on Factory Rd – regardless of a drainage detention pond or other run-off mitigation measures. Our tax dollars already paid to fix this flooding area.
10. Significant increases in air pollution, water pollution, noise pollution, light pollution are inevitable with this project.
